These Terms of Use govern your access to and use of the Treatsugarmodel platform, including all features, content, workshops, exercises, and tools available at treatsugarmodel.biz. By accessing or using this platform, you agree to be bound by these terms. If you do not agree, you must not use the platform.
1. Acceptance of Terms
By creating an account, enrolling in a workshop, or otherwise accessing any part of the platform, you confirm that you have read, understood, and agreed to these Terms of Use, as well as our Privacy Policy. These terms form a binding agreement between you and Treatsugarmodel.
We reserve the right to update or modify these terms at any time. When we do, we will revise the Last Updated date at the top of this page. Continued use of the platform after changes are posted constitutes your acceptance of the revised terms.
2. Eligibility
You must be at least 16 years of age to use this platform. By using the platform, you represent and warrant that you meet this age requirement. If you are accessing the platform on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
3. Account Registration
3.1 Creating an Account
Certain features of the platform require you to register for an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.2 Account Security
You must notify us immediately at contact@treatsugarmodel.biz if you become aware of any unauthorised use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to protect your account credentials.
3.3 Account Termination by User
You may close your account at any time by contacting us. Upon closure, your access to paid or enrolled content may be revoked in accordance with our refund and cancellation policies.
4. Platform Access and Use
4.1 Permitted Use
You may use the platform solely for lawful, personal, non-commercial educational purposes unless you have entered into a separate written agreement with Treatsugarmodel permitting other uses. You agree to use the platform in a manner consistent with all applicable laws and regulations.
4.2 Prohibited Conduct
You must not engage in any of the following activities:
- Reproducing, distributing, or publicly displaying any platform content without prior written permission
- Sharing your account credentials or allowing others to access the platform through your account
- Attempting to gain unauthorised access to any part of the platform or its underlying infrastructure
- Uploading or transmitting malicious code, viruses, or any software intended to disrupt platform functionality
- Scraping, crawling, or extracting data from the platform by automated means
- Impersonating any person or entity or misrepresenting your affiliation with any person or entity
- Engaging in any conduct that is harassing, abusive, defamatory, or otherwise harmful to other users or to Treatsugarmodel
- Using the platform to advertise or promote third-party products or services without authorisation
- Circumventing any technical measures used to protect or restrict access to content
5. Intellectual Property
5.1 Treatsugarmodel Content
All content on the platform, including but not limited to workshop materials, exercises, videos, written guides, assessments, graphics, and software, is the intellectual property of Treatsugarmodel or its licensors. Nothing in these terms grants you any ownership rights in platform content.
5.2 Limited Licence
Treatsugarmodel grants you a limited, non-exclusive, non-transferable, revocable licence to access and use platform content solely for your personal educational use during the period of your active enrolment or subscription. This licence does not permit you to download, copy, modify, or redistribute content except where explicitly enabled by platform features.
5.3 User Submissions
If you submit any content to the platform, including assignments, forum posts, or collaborative work, you grant Treatsugarmodel a non-exclusive, worldwide, royalty-free licence to use, store, display, and reproduce that content for the purposes of operating and improving the platform. You retain ownership of your submissions and are solely responsible for their accuracy and legality.
6. Payments and Subscriptions
6.1 Fees
Access to certain workshops and features requires payment of applicable fees. All fees are displayed on the platform at the time of purchase. Prices are subject to change, and changes will not affect enrolments already completed at the previous price.
6.2 Billing
By providing payment information, you authorise Treatsugarmodel or its payment processors to charge the applicable fees to your payment method. You are responsible for ensuring your payment details are accurate and up to date.
6.3 Refunds
Refund eligibility is determined by the refund policy applicable to each workshop or subscription at the time of purchase. Please review the specific refund terms before completing a transaction. Treatsugarmodel does not guarantee refunds outside the stated policy window.
6.4 Taxes
You are responsible for any taxes, duties, or levies applicable to your purchase under the laws of your jurisdiction. Where required, Treatsugarmodel may collect and remit applicable taxes on your behalf.
7. Third-Party Services and Links
The platform may contain links to third-party websites, tools, or services. These are provided for convenience only. Treatsugarmodel does not endorse, control, or assume responsibility for any third-party content or services. Your use of third-party services is at your own risk and subject to their respective terms and policies.
8. Privacy
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. By using the platform, you consent to the collection, use, and processing of your information as described in the Privacy Policy.
9. Disclaimers
The platform and all content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Treatsugarmodel does not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We do not guarantee that any particular learning outcome will be achieved through use of the platform.
To the fullest extent permitted by applicable law, Treatsugarmodel disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Treatsugarmodel and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the platform, even if advised of the possibility of such damages.
In no event shall Treatsugarmodel's total aggregate liability to you for any claims arising out of these terms or your use of the platform exceed the greater of the total amount you paid to Treatsugarmodel in the twelve months preceding the claim or one hundred South African Rand (R100).
11. Indemnification
You agree to indemnify, defend, and hold harmless Treatsugarmodel and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the platform, your violation of these terms, or your infringement of any third-party rights.
12. Suspension and Termination
Treatsugarmodel reserves the right to suspend or terminate your account and access to the platform at any time, with or without notice, if we reasonably believe you have violated these terms, engaged in fraudulent activity, or if required to do so by law. Upon termination, all licences granted to you under these terms will immediately cease.
Provisions of these terms that by their nature should survive termination, including intellectual property rights, disclaimers, and limitations of liability, shall continue to apply after termination.
13. Modifications to the Platform
Treatsugarmodel reserves the right to modify, suspend, or discontinue any part of the platform at any time, including features, content, pricing, or availability, without prior notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.
14. Governing Terms
These Terms of Use represent the entire agreement between you and Treatsugarmodel regarding your use of the platform and supersede all prior agreements, understandings, or representations relating to the same subject matter.
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Failure by Treatsugarmodel to enforce any right or provision shall not constitute a waiver of that right or provision.
